Terms of Service
Effective date: May 24, 2026 · Last updated: May 24, 2026
1. Agreement to Terms
By accessing or using the services operated under the brand Collision (“the Service”), provided by Collision Technologies S.R.L.S — Società Benefit, a company incorporated under Italian law with registered office at Via Fabio Filzi 6, 34132 Trieste, Italy (“we”, “us”, or “our”), you enter into a legally binding contract governed by these Terms of Service. If you do not agree to all terms set out herein, you must immediately cease using the Service. These Terms apply to all visitors, registered users, API consumers, and any other person who accesses or interacts with the Service. (Art. 6(1)(b) GDPR — processing necessary for the performance of a contract)
We may update these Terms from time to time to reflect changes in law, our services, or business practices. We will notify you of material changes by posting revised Terms on this page and updating the “Last updated” date. Where required by law, we will provide advance notice. Your continued use of the Service after the effective date of revisions constitutes your acceptance of the updated Terms. (Consumer Rights Directive 2011/83/EU — Art. 9–16 for digital content and services)
2. Eligibility
You must be at least 16 years of age to create an account or use the Service. By using the Service, you represent and warrant that you are 16 or older and have the legal capacity to enter into a binding contract under applicable law. If you are acting on behalf of a legal entity — including a company, institution, or organisation — you represent that you have full authority to bind that entity to these Terms and that the entity accepts responsibility for all actions taken under your account. (Art. 8 GDPR — conditions applicable to child's consent)
We do not knowingly provide the Service to persons under the age of 16. If we become aware that a user is under 16, we will suspend the account without prior notice and delete associated personal data in accordance with our Privacy Policy. (Art. 17 GDPR — right to erasure)
3. Description of Service
Collision provides AI-powered text analysis tools accessible via a web interface and a programmatic API. Current features include AI-generated content detection, text paraphrasing assistance, multilingual AI agent interactions, and related analytical services. Features may be introduced, modified, or discontinued at our discretion and without liability, subject to reasonable advance notice where required by applicable consumer law. (Consumer Rights Directive 2011/83/EU — Art. 3)
Important: Our AI detection tools provide probabilistic assessments based on statistical models. Results are indicators, not definitive proof. AI content detection is an evolving field and no system can guarantee 100% accuracy. You must not rely solely on our results for legal proceedings, academic disciplinary decisions, employment actions, or any other consequential determination without independent verification.
4. User Accounts
To access protected features, you must register an account using a supported authentication provider (Google, GitHub, or LinkedIn). You are solely responsible for: maintaining the confidentiality and security of your login credentials; all activity that occurs under your account; and notifying us immediately at contact@collitech.org of any suspected unauthorised access, breach, or misuse. We are not liable for any loss or damage arising from your failure to protect your credentials. We reserve the right to suspend or terminate any account that we reasonably believe has been compromised or is being used in violation of these Terms. (Art. 5(1)(f) GDPR — integrity and confidentiality)
5. Credits, Payments & Refund Policy
The Service operates on a credit-based model. Credits are consumed each time you use a credit-gated AI analysis or generation feature. You may purchase additional credits through the in-app purchase flow. All payment transactions are processed exclusively by Stripe, Inc., a PCI-DSS Level 1 certified payment processor. (Art. 6(1)(b) GDPR — contract performance; Art. 28 GDPR — processor relationship with Stripe)
We never receive, process, store, or have access to your card number, CVV, expiry date, IBAN, or any other banking or payment credentials. All such information is entered directly into Stripe's secure payment interface and remains exclusively within Stripe's systems. Upon successful completion of a payment, we receive only a confirmation notification from Stripe and credit your account accordingly.
All credit purchases are final. Refunds may be issued at our sole discretion in cases of verified technical error where credits were deducted without a corresponding result being delivered. Refund requests must be submitted to contact@collitech.org within seven (7) calendar days of the incident, with a description and evidence of the error. Purchased credits do not expire, are non-transferable, and may not be resold or exchanged for cash. We reserve the right to adjust pricing at any time; previously purchased credits are not affected by price changes. (Italian Consumer Code D.Lgs. 206/2005 — Art. 52 et seq. for distance contracts involving digital content)
6. API Usage
API access is subject to rate limits and usage quotas documented in the Service. API credentials are personal, confidential, and must not be shared, embedded in publicly accessible code, or transferred to third parties. By using the API, you agree not to: exceed documented rate limits or attempt to circumvent them through technical means; use the API for any purpose not permitted by these Terms; redistribute, resell, or sublicense API access without our prior written consent; or reverse-engineer the models or algorithms underlying our detection services. We may revoke API access immediately and without prior notice if these obligations are violated. (Art. 6(1)(f) GDPR — legitimate interests in protecting service integrity)
7. Prohibited Conduct
When using the Service you agree not to: attempt to bypass, disable, or interfere with security features, rate limits, authentication mechanisms, or access restrictions; use the Service to facilitate plagiarism, academic fraud, financial fraud, impersonation, or any activity that is unlawful under applicable law; reverse-engineer, decompile, disassemble, or otherwise attempt to extract source code, model weights, or proprietary algorithms from the Service; use automated scripts, bots, crawlers, or scraping tools to access the Service beyond the permitted API; transmit viruses, malware, ransomware, or any code designed to damage or gain unauthorised access to systems; harass, threaten, abuse, or harm any person through or in connection with the Service; or impersonate any individual, legal entity, or our personnel. Violation of this section may result in immediate account termination and, where appropriate, referral to law enforcement authorities. (Directive (EU) 2016/1148 on Network and Information Security; Italian Penal Code Art. 615-ter et seq.)
8. Intellectual Property & Zero-Retention
8.1 Our Intellectual Property
The Service — including its design, codebase, interface, branding, and underlying technology — is and remains the exclusive property of Collision Technologies S.R.L.S — Società Benefit, protected by copyright, trademark, trade secret, and other applicable intellectual property laws. You may not copy, adapt, distribute, sublicense, or create derivative works based on our Service or its components without our prior written permission. (Directive 2001/29/EC on the harmonisation of certain aspects of copyright and related rights)
8.2 Your Content & Zero-Retention Guarantee
You retain full ownership of all text and content you submit to the Service. We operate a strict zero-retention policy: submitted text is processed exclusively in-memory for the duration of a single request and is discarded immediately upon completion. We never store, log, index, share, or use your inputs or outputs for any secondary purpose, including model training, improvement, or analytics. We do not profile, analyse, or infer characteristics from your submitted content. (Art. 5(1)(e) GDPR — storage limitation; Art. 5(1)(b) GDPR — purpose limitation)
9. Limitation of Liability
To the fullest extent permitted by applicable law, Collision Technologies S.R.L.S — Società Benefit, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption — arising out of or in connection with your access to or use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. (Art. 6(1)(f) GDPR — limitation grounded in legitimate interests of the data controller)
Our total aggregate liability to you for any claim arising out of or in connection with these Terms or the Service shall not exceed the total amount you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law, including mandatory rights under the Italian Consumer Code (D.Lgs. 206/2005) and the Consumer Rights Directive (2011/83/EU).
10. Termination
We may suspend or terminate your access to the Service at our sole discretion, with or without prior notice, for conduct that we determine violates these Terms, is harmful to other users, third parties, or our business, or for any other reason we reasonably consider appropriate. Upon termination: your right to access and use the Service ceases immediately; unused credits may be forfeited unless termination was caused by our material breach; provisions of these Terms that by their nature should survive termination — including Sections 8, 9, and 11 — will continue in full force and effect. (Art. 17 GDPR — right to erasure upon account deletion)
You may delete your account at any time through your account settings. Upon account deletion, your personal data will be erased in accordance with our Privacy Policy and applicable GDPR obligations. As we retain no user-submitted content, there is no content deletion step required beyond account closure.
11. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Italian Republic, without regard to its conflict of law rules. Subject to any mandatory consumer rights under Italian or EU law, any dispute arising from or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Trieste, Italy. (Italian Civil Code Art. 1321 et seq.; D.Lgs. 206/2005 — Italian Consumer Code)
If you are an EU resident, you may also be entitled to submit a dispute to the European Commission’s Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr. (Regulation (EU) No 524/2013 on online dispute resolution for consumer disputes)
12. Severability & Entire Agreement
If any provision of these Terms is held to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy and any other policies or agreements expressly incorporated by reference, constitute the entire agreement between you and Collision Technologies S.R.L.S — Società Benefit with respect to the Service and supersede all prior agreements, representations, and understandings.
